As per Census 2011 reports child sex ratio for India is 919. It was 946 in year 1991 and 927 in year 2001. It reduced by 8 points from year 2001 to year 2011. States and Union Territories showing maximum decline are Jammu & Kashmir (-79 points), Tripura (-64 points), Dadaranagar Haveli (-53 points), Lakshadeep (-48 point). States and Union Territories showing improvement in child sex ratio are Punjab (48 points), Chandigarh (35 points), Haryana (15 points), Himachal Pradesh (13 points), and Andman Nikobar (11) Arunachal Pradesh (8 Point), Gujart (7 point).
The general sex ratio for Maharashtra shows a decline by 12 points in census 2001 as compared to census 1991; however there is a marginal improvement by 7 points in census 2011. Whereas child sex ratio (0-6 years) shows a decline by 33 points in census 2001 as compared to census 1991. It has further declined by 19 points in census 2011 compared to census 2001.
Maximum decline in child sex ratio is observed in Beed district (87 points) and minimum decline is observed in Gondia district (2 points). There are only 4 districts in the entire State, which shows marginal increase in the child sex ratio. These are Satara (17 points), Kolhapur (24 points), Sangli (16 points) and Chandrapur (14 points). All other districts show decline in child sex ratio. There are 3 districts which shows decline by more than 50 points. These are Beed (87 points), Buldhana (53 points), and Washim (55 points). There are 7 districts which shows decline in child sex ratio between 30 to 50 points.
Generally sex ratio of 952 is the average expected sex ratio in the population. Considering this and comparing it with child sex ratio of 2011 Census, we may say that, 406566 female feticidesmayhave occurred in the state.
The Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 was enacted to provide for the regulation of the use of pre-natal diagnostic techniques for the purpose of detecting genetic or metabolic disorders or chromosomal abnormalities or certain congenital malformations or sex linked disorders and for the prevention of the misuse of such techniques for the purpose of pre-natal sex determination leading to female feticide and for matters connected therewith or incidental thereto. For last few years there has been enormous increase in the no. of sonographycentre which have mushroomed in rural as well as Periurban areas are blamed for conducting unscrupulous activity of sex determination at nominal cost. This has lead to significant rise is the Sex selection throughout.
In most of Indian families the welcome of male child is done resulting in tremendous growth and popularity of centers doing sex determination followed by sex selective abortions. Such abuse of techniques is crime against female sex, diminishing the dignity and honor of woman. It was thought appropriate to come out with a legislation which could regulate the use of, and to provide deterrent punishment for the violation of the provisions of the legislation. This Act was assented by the President on 20th September, 1994 and has been enforced with effect from 1st January, 1996 vide G.S.R. 706, dated 20th December, 1995.
This act was been amended in 2003 as The Pre Conception and Prenatal Diagnostic Techniques (Prohibition of Sex Selection) Act.

- Constitution of Task force at district level :-
District Task force is constituted under chairmanship of the District Magistrate for implementation PCPNDT Act vide Government Resolution in Marathi No Prachini2011/CR256/FW-2 dated 13 October 2011. The meetings of this task force are being organized time to time.
- Hearing before State Appropriate Authority: –
There is provision as per section 19(2) one can appeal to State Appropriate Authority if he/she doesn’t satisfy himself by decision of District Appropriate Authority. So far 147 appeals have been filed to State Appropriate Authority and 147 heard decision communicated to appellant and respondent.
- Crash Inspection Programme for inspection of all Hospitals& Nursing Homes (Clinical Establishment) in state:-
- From 15/03/2017 to 31/05/2017 Crash drive Programme is being conducted for inspection of all Hospitals (Clinical Establishment) in state. Joint teams constituted (Police, Revenue, Health and Food and Drug Department) for Crash drive inspection.
- Till 31/05/2017, 37068 clinical establishments were inspected and in 6742 Hospitals where irregularities are observed as per Bombay Nursing Home Registration Act, Maharashtra Pollution Control Act, Fire Regulation, Medical Termination of Pregnancy Act , PCPNDT Act. Districts level Committee is constituted under the chairmanship of District collector for to take action against hospitals & doctor who are violate provision of above said Act.
- Reinspetion of 6742 clinics/hospital where irregularities obsersed was taken during 1 May 2018 to 30 June 2018. During This drive 6742 Centers were inspected.
- Crash Inspection Programme for Sonography Centers and MTP Centers :-
- Crash Programme of inspection of Sonography centers and MTP Centers was taken in the state during 20 January 2022 to 05 March 2022. All district and sub district level appropriate authorities have been instructed to visit all sonography centers and MTP centers in their respective areas. They have also been instructed to seal the sonography machine and to lodge court case against the center if any violation of the Act is observed. In case of MTP centers they are instructed to suspend the license if violation of act is observed.
- Till up to 05 March 22 A total of 10372sonographycentres and 5927 MTP centres inspected during this inspection drive
- Special drive Programme of inspection of Sonography centers and MTP Centers was taken in the state during 5June 2024 to 25 June 2024. A total of 11586 sonographycentres and 6056 MTP centres inspected during this inspection drive.
Jurisdiction of District & Corporation Appropriate Authority:-
Civil surgeon for Rural &Municipal council area and medical officer of health for urban area is appointed as Approprate Authority.

Various Schemes and Activities:-
Supportive Activities from RCH PIP:-
In RCH PIP 2024-26 following activities are implemented. A budget of Rs. 135.40 Lakhs is approved to implement following activities,
- Support for sting operation under PCPNDT Act.
- Provision for Witness support participated in PCPNDT court cases.
- Divsional level orientation workshops for District and Corporation Appropriate Authorities
- Award to informers of sonography centers practicing illegal sex determinations.
- Moblity support to District level
Publicity and Awareness:-
To create awareness among population various activities are being undertaken such as organization of rallies, distribution of pamphlets, posters, flipcharts, Fequently asked qusetion books, display of hoardings, workshops for members of FOGSI, NIMA, IAMA, seminars and training sessions for appropriate authorities and district judges, printing of booklets namely “ChakulyaMuklelya” containing districts maps showing sex ratio of each block book has been distributed in all district.Publicity during Ganesh &Durga puja festival pandalsis undertaken.

Major Achievement:-
- State has started Toll free no.18002334475 / 104 to register complaint & queries regarding PCPNDT Act. Up to February 2025, 1124 complaints have been registered on the Toll Free no. out of which 1102 complaints have been complied. 30202 Calls have been received for regarding PCPNDT and MTP, counseling have been done.
- amuchimulgimaha.in website is launched for grievance registration related illigle MTP and sex determination on 15th March 2024. Till February 2025 103 complaints received and 82 complaints resolved.
- Interstate Workshop for Bordering States of Maharashtra was organized on 7th February 2017
- Interstate Workshop for Bordering States of Maharashtra was organized on 18th May 2018
Online F-Form:-
- pcpndt.mahaonline.gov.in website launched for online A & F-Form
- It is mandatory for all sonography centers to fill up all “F” form Online.
State Medical Council Status:-
- Since June 2012, on recommendation of 219 doctors by State Appropriate Authority to 3 State Medical Council following action initiated against PCPNDT Act violators.
- Registration of 62 doctors have been suspended by Maharashtra Medical Council
- 10 Registrations have been suspended by Homeopathy council.
- 4 Registrations have been suspended by Council for Indian Medicine
Award to informers of sonography centers practicing illegal sex determinations
- Scheme objective: Identification and deterrent punishment to the violators of the PCPNDT Act.
- Scheme Nature: Under this scheme, it is proposed to pay a lump sum amount of Rs. 1, 00,000/- to the informer.
- After getting the information, Dist/corporation Appropriate Authority Visits/inspects the center.
- If something is wrong happening is noted the machine is sealed and the case is lodged in court. Then informer is given the award.
- If he desires, his name is kept confidential.
- Scheme benefits: – award is given to 03 informers in the year 2022-23 for giving information of sonography centers engaged in sex determinations and violating the provisions of the act.
Decisions Taken:
- Registration will be mandatory for manufacturer, dealer with State Appropriate Authority. Upto February 2025 total of 492 Manufacturers/dealers are registered with the State Appropriate Authority.
- Manufacturer dealers are instructed to give information about buy back machine, new machine should be provided to State Appropriate Authority.
- Sonography or imaging machine should be purchased from those who are registered with State Appropriate Authority.
- Displaying board on sealed sonography centers is mandatory

- MEDICAL TERMINATION OF PREGNANCY ACT (MTP)
The Medical Termination of pregnancy (MTP) Act was enacted in 1971 and amended in 2002& 2021. It provides the framework for safe and legal abortion services for MTPs in the country. The act allows termination of pregnancy up to 24 weeks gestation for a broad range of indication by approved medical practitioners. The MTP Act offers protection to a practitioner if she/he fulfils all the requirements of the AmmendedAct.
- Salient features of the MTP Act 1971:-
- Gestational limit for MTP In India: It was legal to terminate pregnancy up to 20 weeks till amendment 2021. But as per amendment 2021, it is legal to terminate pregnancy till 24 weeks.
- MTP Act 1971:-
According to the MTP Act, Pregnancy can be terminated only doctor is of the opinion that:-
- Continuation of pregnancy is a risk to the life of the pregnant women or it can cause grave injury to her physical or mental health.
- Substantial risk that the child, if born, would be seriously handicapped due to physical or mental abnormalities
- The pregnancy was caused by rape (presumed to constitute grave injury to mental health)
- Pregnancy caused due failure of contraceptive in married women or her husband (predumed to constitute grave injury to mental health)
- Who can perform MTP as per MTP Act 1971:-
- According to the MTP Act, in India, an obstetrician and gynecologist can provide MTP services up to 24 weeks of pregnancy as per ammendments 2021. He/she should be a registered medical practitioner who possess a recognized medical qualification as defined in the Indian Medical Council Act, 195, has her/his name should entered in a state medical register and has such experience or training in gynecologist and obstetrics prescribed the MTP rules. Post graduate/diploma in OBGY can also provide MTP Services.
- 6 months experience in obstetrics and gynecology.
- 1 year experience in a government maintained center with all the facilities. MBBS doctor can provide MTP services up 20 weeks of pregnancy. He/she should be registered medical practitioner and possess a recognized medical qualification as define in the Indian Medical Council 1956, has her/his name entered in a state medical register and has successfully completed the MTP training as per the Government of India norms. (The MTP Act does not permit ANMs, Staff Nurses, TBAs or other untrained personnel to conduct abortion procedures. However they can counsel, provide post abortion care and provide appropriate referral services for MTP and post abortion care.)
- Places where MTP can be done:-
A pregnancy can be terminated in a hospital established or maintained by the Government. The Government facilities are automatically approved for providing MTP, Thus no other approval is required to staff services.
OR
A place (nursing home/private clinic/NGO) approved by the Government or a District-Level committee constituted by the Government.

- Consequences / penalty on violating the MTP Act 1971:-
- Any person terminating a pregnancy, who is not a registered medical practitioner, can be punished with rigorous imprisonment for a minimum of two years and a maximum of seven years. Anyone terminating a pregnancy at a place which is not approved, can be punished with rigorous imprisonment for a minimum of two years and a maximum of seven years
- The owner of a non- approved place, where termination of pregnancy is performed can also be punished with rigorous imprisonment for a minimum of two years and maximum of seven years.
- (If termination is performed by a registered medical practitioner in good faith to save a women’s life, it will not be treated as an offence even if it is done at a non approved site or by a registered medical practitioner who does not fulfils the legal requirements to perform MTP)
